Legal Actions Against Financial Institutions with Epstein Connections Could Shed New Light on Billionaire’s Crimes

For years, victims of the late financier Jeffrey Epstein have demanded justice. For a while, it appeared like they would get it.

Epstein’s former associate Ghislaine Maxwell, the financier’s one-time partner, was found guilty of sex trafficking in a 2021 trial for her role in the deceased billionaire’s exploitation of underage females – and given to two decades behind bars.

At the same time, banks that had worked with Epstein, although not admitting wrongdoing, paid hundreds of millions in settlements to survivors. Donald Trump even made releasing the Epstein investigative files part of his election promises, and doubled down on his promise to do so early this year.

In the end, Trump’s justice department did not release these records, and his administration has become embroiled in allegations about personal connections between him and Epstein. Assurances from lawmakers to disclose documents have stalled, due to partisan maneuvering and delays from federal authorities.

But two new lawsuits could provide clarity on Epstein’s operations amid the deadlock – regardless of their outcome.

Lawsuits Aim at Major Banks

The legal complaints, filed by an anonymous plaintiff against a major U.S. bank and the Bank of New York Mellon (BNY), allege that these financial powerhouses unlawfully facilitated Epstein’s sex trafficking. The suits are helmed by Sigrid S McCawley, of a prominent law firm, and lawyer Brad Edwards of his legal practice, who have consistently advocated for Epstein victims.

“Epstein committed these crimes by means of not only his own extraordinary wealth and influence, but through financial backing and monetary assistance from both individuals and institutions, including BNY,” the legal filing claims. “Shockingly, BNY had a plethora of information regarding Epstein’s sex trafficking operation but chose profit over protecting the victims.”

The complaint against Bank of America echoes these allegations, declaring the institution “deliberately supplied the financial support and the appearance of respectability for Epstein and his co-conspirators to fuel their international sex trafficking organization under the pretext of legal commercial dealings”. The suit also said Bank of America neglected to file suspicious activity reports.

Legal Experts Weigh In on Case Challenges

Longtime attorneys who spoke to the situation said establishing liability would be difficult. But they also identified possible outcomes which could provide solace to plaintiffs or disclosure of previously hidden details.

Attorney Neama Rahmani, a former federal prosecutor who founded a legal firm, said proof has to show that an bank’s conduct led to harm.

“In my view, the case faces significant obstacles – and clearly I am on the side of the victims, and I want them to get explanations and criminal justice and compensation,” Rahmani said. Some claims might be not directly related from a legal standpoint.

“The case hinges on proof,” Rahmani said. A lawyer would need to prove causation, which would mean “but for the defendant’s conduct, the injury wouldn’t have occurred”. In this case, that would translate to “but for the bank’s conduct, the victim maybe wouldn’t have been exploited”, the lawyer clarified.

An attorney would also have to go further than a basic causation test. “It’s not solely about indirect cause. It also has to be a significant element: that is the standard. So whatever misconduct there was, if there was any wrongdoing … the defendant’s misconduct has to have been a key contributor in causing the victim’s suffering.

“By engaging in a business relationship with Epstein, is that a decisive element? It’s uncertain.”

Liability aside, suits like this could serve as a warning that relationships with those accused of wrongdoing can have damaging implications for them.

“It represents a reputational disaster,” he said. If the banks try to get these suits dismissed and fail, Rahmani anticipates a quick resolution. “No party desires to pursue any of the Epstein-related cases.”

Eric Faddis, a litigator and founder of the Colorado law firm Varner Faddis and former prosecutor, said companies can be liable. In this scenario, “if the institutions bear fault is going to hinge, in part, on their level of awareness, if they were informed of claimed misconduct or criminal wrongdoing”, and somehow provided assistance to Epstein.

“But even then, I think it’s going to be difficult to effectively connect the banks into some kind of trafficking operation. The banks would probably not be aware of the details of claims,” Faddis said. While the financier’s prior legal case was known, “there’s no law against for a bank to have a client who’s an unsavory person”.

“It is illegal for a bank to somehow be involved in the illegal actions of a customer, but those two issues are very different, and so I think that it’s going to be a difficult case against the institutions.”

Possible Advantages for Victims

That said, key elements of the litigation could help Epstein survivors.

“These cases may uncover additional details about the ongoing Epstein saga,” Faddis said. “Despite the fact that there have been sort of walls put up at every turn for folks seeking this information, when there’s a legal action, there’s a evidence-gathering phase, and that discovery process often mandates release of information that was not previously public.”

Edwards said in a statement that the suits could have a preventive impact and accomplish what lawmakers have failed to do.

“Legal actions are essential for full accountability for the victims of the financier – as well as for future would-be victims who will suffer from similar trafficking organizations – if our financial institutions are not held accountable for the crucial part each performs, either in supplying the necessary infrastructure for the criminal enterprise or recognizing the financial component of these offenses and putting an end to it.

Edwards continued: “We have a far better chance of making a real difference than lawmakers, because we know the details and background of the matter and are not driven by politics but rather by a genuine desire to create substantial impact and to safeguard the victims, who have already suffered tremendously.

“We approach these matters without any partisan motives and thus cannot be deterred by obstructions, protecting wealthy politically connected individuals, or the other embarrassing partisan gamesmanship you and the rest of the world have had to watch unfold recently.”

Attorney Sigrid McCawley said in a declaration: “While legislators attempt to uncover how Jeffrey Epstein was able to orchestrate his illegal trafficking operation for decades without detection, we are taking a further significant action forward toward legal resolution for victims.”

Bank Responses

Asked for comment on the legal complaint, BNY said: “The allegations in the case are baseless, and we will strongly contest against it.”

The bank’s response similarly remarked: “We will vigorously defend ourselves in this case.”
