A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.

The situation originates in a mistaken deportation to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer human smuggling charges, he was held in federal custody.

In her order, the court pointed out that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

The court challenge involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.

The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now comply with the terms of his release from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
